Entrants acknowledge and agree that, by participating in The Ten Ton Hammer ”Win Free Games for a Year” contest, they have read and understand the official contest rules, and that they will abide by the official contest rules.

OFFICIAL CONTEST RULES

1. HOW TO ENTER THE CONTEST:

Step One

If you haven't already, become a registered member of Ten Ton Hammer.

Step Two

Navigate to our Win Free Games for a Year Contest entry page and complete the required steps.

Premium Member Bonus

Entrants who are Ten Ton Hammer Premium Members at the time of entry will receive their Premium Edge bonus, which will make their single contest entry count as ten. Registered members may upgrade to premium in order to take advantage of the Premium Edge at any time prior to submitting their entry form.

2. ELIGIBILITY:

(a) The contest is open only to adults 18 years of age or older.

(b) Master Games International, Inc. employees, its affiliated advertising/public relations agencies, participating sponsors/promotional partners, and the members of their immediate families are ineligible to enter or win.

(c) Winner must be able to accept digital delivery of games via Steam. In the event that the winner is unable to receive delivery through Steam, an alternate digital delivery method may be considered. If winner is unable to accept delivery, the prize will be forfeited. Ten Ton Hammer is in no way affiliated with Steam or Valve Corporation.

3. SELECTING THE WINNER:

One grand prize winner will be drawn at random on Thursday, December 15, 2011. Winner will be notified via email and, if necessary, phone. In the event that the winner is unreachable within 3 business days, the prize will be forfeited and an alternate winner will be selected.

4. PRIZE:

The winner of Ten Ton Hammer's Free Games for a Year Contest will receive up to six (6) digital game downloads of their choice between December 15, 2011 and December 31, 2012.

Special Conditions

  • Each chosen game (up to six (6) total) may have a retail value no greater than $60 US. (Total prize value: $360 US)
  • Every attempt will be made to grant pre-order requests for the winner, but Ten Ton Hammer does not guarantee delivery of any title prior to its scheduled release. Ten Ton Hammer is not responsible for games that are undeliverable due to development delays or technical issues with digital delivery beyond Ten Ton Hammer's control.
  • Winner is responsible for notifying Ten Ton Hammer of his or her request for an upcoming game. (Ten Ton Hammer will provide special means of contact and verification.) Prizes unclaimed by December 31, 2012 will be forfeited.

5. CONDITIONS:

(a) No purchase necessary.

(b) The contest is void where prohibited or where restricted by U.S., international, federal, state or local law.

(c) Entrants are required to provide truthful information. Master Games International, Inc. will reject and delete any entry (on-site, Internet, or mail-in) that it discovers to be false or fraudulent or to contain any incorrect statement.

(d) Contest entries become property of Master Games International, Inc. and will not be returned.

(e) Entrants declare that the entry is submitted by them and not by a third party on their behalf.

(f) Master Games International, Inc. will be permitted to use the entry without further notice or approval of the contest winner.

(g) No royalties are payable to the contest winner for Master Games International, Inc.’s use of the entry (if any) and no further consideration will be provided to the contest winner (other than prizes).

(h) Entrants in the contest, the winner and their guests agree to have their names, voices, or likeness used in any advertising or broadcasting material relating to this contest, without additional financial or other compensation, and will sign a publicity release to that effect. Contest winner may be required to sign a liability/publicity release prior to acceptance of the prize. Pursuant to the liability/publicity release, the winner will agree to hold Master Games International, Inc., its affiliated companies and officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

(i) Master Games International, Inc. is not responsible for technical, hardware, software or telephone failures of any kind, loss or delay of mail, lost or unavailable network connections, fraud or incomplete, garbled or delayed computer transmissions, whether caused by the sponsors, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submission which may damage a user’s system or limit an entrant’s ability to participate in the contest. Master Games International, Inc. reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or with the operation of the contest.

(j) Any and all disputes, claims and causes of action arising out of or connected with this contest, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorney’s fees.

(k) Master Games International, Inc. reserves the right, in its sole discretion, but shall in no event be obligated, to cancel, terminate or suspend part or all of this contest should viruses, bugs, non-authorized human intervention, loss by any cause of mailed-in entry forms or other causes corrupt or impair the administration, security, fairness or proper play of the contest or for any other reason.

(l) Master Games International, Inc. reserves the right to make changes to the rules of the contest, including the substitution of a prize or prizes of equal or greater value, which will become effective upon announcement and Master Games International, Inc. shall incur no liability with respect to such changes.

(m) Failure to comply with the contest rules may result in an entrant’s disqualification at the sole discretion of Master Games International, Inc.

(n) The Ten Ton Hammer ”Win Free Games for a Year” contest shall be governed by and construed in accordance with the laws of the State of Texas, U.S.A. Entrants in the contest, the winners and their guests agree irrevocably to conform to the non-exclusive jurisdiction of the Courts of such State and hereby waive all defenses of lack of personal jurisdiction and forum non conveniens.

(n) Fraudulent entries will be deleted.

(o) Prizes are not transferable.

(p) All prizes are awarded “AS IS” and without warranty of any kind, expressed or implied, except as provided by the manufacturer or digital retail vendor.

(q) The contest is being operated solely by Master Games International, Inc and is not in any way affiliated with any specific developer, game title or vendor.
