Earlier today, it seemed like Interplay might have been off the hook in their legal battles with Bethesda over the Fallout IP. Duck and Cover reported that Bethesda had dropped its appeal against Interplay, freeing up the struggling developer to continue its Fallout MMORPG codenamed Project V13. Duck and Cover posted the story earlier today, citing comments from Interplay investor Frymuchan, who talked about a secret deal that was struck between the two companies.



However, all is not as well as it might seem given the news. Gamasutra reports that in an SEC filing, Interplay still intends to pursue its counterclaims against Bethesda for breach of contract, declaratory judgment and an award for damages, attorney fees and other relief. To add to the turmoil, Kotaku has gotten comments from Bethesda's Pete Hines, who states that Bethesda has not dropped its claim, but that the situation is still an ongoing legal issue and what took place recently was a minor legal procedural thing and not a dropping of the lawsuit.
