Square Enix has one less thing to worry about this week. The 9th Circuit Court of Appeals in California has dismissed a 2009 class action lawsuit filed by San Francisco resident and Final Fantasy XI player Esther Leong, who alleged that the publisher engaged in "deceptive advertising, unfair business practices, and fraudulent concealment for the game.
Leong was seeking over $5 million in damages following the deletion of her characters after taking a break from the game and returning to find her account invalidated and characters loss due to the billing method of Square Enixs PlayOnline service. Last week, the 9th Circuit Court of Appeals in California dismissed the claim with prejudice.
