Mytheon seemed to be moving along at a steady pace with its development, but as the game approaches its official launch it appears to have hit an unexpected snag. So to continue in our recent trend of industry related lawsuits, True Games Interactive (TGI), Mytheon's publisher, has sued developer Petroglyph for the Mytheon source code. According to court documents, an agreement was reached between TGI and Petroglyph to meet certain milestones that TGI alleges Petroglyph failed to meet. Despite that, TGI states that it advanced emergency funding to help Petroglyph continue development.

In late April 2010, Petroglyph submitted an Open Beta build to TGI. The Open Beta ran to the public from April 28th through May 2nd, 2010 in what TGI states, "It was so unstable, however, and prone to errors, crashes, and bugs, that it became obvious that either Petroglyph did not have the skills to complete the game (which, given the background of its principle seemed unlikely), or that Petroglyph was intentionally delaying and/or failing to produce a quality product as a means of squeezing more money and concessions out of TGI." TGI claims to have given Petroglyph a development advancement sum of nearly $5,000,000.

TGI believes that Petroglyph completed just enough of the game to get TGI to pay more money but not enough to get it published. As such, TGI is suing for the Mytheon source code to be held in escrow and for an appointment of receivership to ensure the game is completed and marketed in a timely manner.
